[MANUSCRIT] - BARTOLUS, of Saxoferrato - [Lectura Infortiati]. Italian manuscript from the first third of the 15th century. On the label on the back of the eighteenth century, it is dated 1406. Calligraphed in cursive gothic script. Southern France, c. 1406-1430. 233 folios on parchment or paper, text in two columns of 50 to 56 lines, ornate lettering. The first 216 leaves consist of quires of 6 leaves each comprising two outer leaves of parchment in which are inserted four leaves of paper. The last seventeen leaves have seven parchment leaves. Two parchment leaves for the endpapers, margins a bit trimmed, reaching some marginalia, bound in 18th century vellum. Numerous watermarked letters in red and blue and thirty-eight colored lettering. Some light stains. First part of Bartole's commentary on the Infortiatum on the two published. Folio 229 : ''Explicit prima pars lecture Bartoli super Inforciato. Deo gratias et beatissime Marie ejusque genetrici et virgini Katerine.'' The dating of 1406 on the binding, which does not appear in the explicit, may come from the glosses or the text added at the end. Bartole de Sassoferrato (1313/1314 - Perugia, 1357) taught law in Perugia and Pisa. He was one of the most important authors in the transmission of Roman law. His commentaries on the Justinian Code were constantly republished until the 17th century. Law chairs were created in the south of France: University of Avignon (civil law in 1263) University of Toulouse, 1229 University of Montpellier, 1249. The MaxPlanck-Institut für europäische Rechtsgeschichte, Manuscripta Juridica, lists up to the year 1500 about 40 copies of this first part preserved in public libraries. The ornamented letter that opens the volume shows a jurist in a tête-à-tête with a woman to whom he is handing over a role. Indeed, the first part of the Infortiatum deals with matrimonial matters such as the results of the dissolution of a marriage by divorce or death, including the recovery of dowry, guardianship, wills and intestate succession. Provenance: Thomas Phillips library ms. no. 4420 listed under this number in the private catalog of his collection (Catalogus librorum manuscriptorum in bibliotheca D. Thomae Phillipps, Bary, Middle Hill Press, May 1837). The book will appear in June 1908 in one of the numerous sales of his manuscript collection, directed by Sotheby's, under the number 68.
